You acknowledge and agree that Qnect LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
7. Users from Outside the United States
If you are accessing the Program from outside the United States, you are responsible for complying with all local laws and regulations.
8. Digital Millennium Copyright Act
Qnect LLC respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please notify Qnect LLC’s designated copyright agent as set forth in the Digital Millennium Copyright Act (“DMCA”).
9. Legal Age; Ability to Accept Terms
You represent and warrant that you are of legal age to enter into these Terms and that you have the authority to bind any entity on whose behalf you may use the Program.
Qnect LLC may give you notice by means of a general notice on the Program, electronic mail to your email address on record, or by written communication delivered in accordance with this Section.
11. Account Termination / Data Maintenance
Qnect LLC may terminate your account and access to the Program at any time, with or without cause, and with or without prior notice. Upon termination, your right to use the Program will immediately cease. Qnect LLC may, in its sole discretion, retain certain data related to your account even after termination of your account.
12. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.QNECT LLC DOES NOT WARRANT THAT THE PROGRAM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PROGRAM OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM.
IN NO EVENT SHALL QNECT LLC, ITS AFFILIATES, OR THEIR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA LOSS, OR LOSS OF GOODWILL) ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE PROGRAM, EVEN IF QNECT LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify and hold harmless QNECT LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or relating to your use of the Program, your violation of these Terms, or your violation of any applicable law or the rights of a third party.
Qnect LLC reserves the right to modify or amend these Terms at any time and without prior notice. The revised Terms will be effective immediately upon posting on the Program. Your continued use of the Program after such modifications or amendments will constitute your acceptance of the revised Terms.
These Terms constitute the entire agreement between you and Qnect LLC with respect to the Program and supersede all prior or contemporaneous communications, representations, and understandings, whether oral or written. Qnect LLC may utilize anonymized and aggregated data captured through the Program for the development and improvement of its AI models and services. This data will not be tied to any specific job, company, or user, ensuring user privacy while allowing for advancements in AI capabilities.
